That is very disappointing.
Well of course. You wouldn’t expect them to take money away from vital things like the Tourist Board or an arts festival, would you? Though if the picture in the BBC article is typical of what they were spending it on, dense even-aged single-species conifer plantations, maybe Scotland’s nature will do better without being restored.

When financial policies/ agreements are not written sufficiently well ( or, being cynical, tha lawyers were directed to leave loopholes) then this is a regular outcome.
Of course, if they are in breach, then lawyers can be engaged to prosecute. A Win/Win situation ( for some).
